Terms & Conditions Policy

These Terms and Conditions govern all bookings, expeditions, treks, climbs, safaris, and related services provided by ApexLine Expeditions Limited (“the Company”, “we”, “our”, or “us”). By confirming a booking or participating in any of our activities, you agree to be bound by these Terms and Conditions.

1. Bookings and Payments
Booking Confirmation

A booking is confirmed upon receipt of a 40% deposit of the total tour cost. The remaining balance must be paid on or before the tour start date, unless otherwise agreed in writing.

Clients may choose to pay the full tour amount at the time of booking.

Accepted Payment Methods
  • Credit and debit cards (Visa, Mastercard, American Express)
  • Bank or wire transfers
  • Other approved online payment platforms

Payments made by bank or wire transfer must include all applicable bank charges, which are the responsibility of the client.

2. Pricing

All prices are based on tariffs, park fees, accommodation rates, and operational costs applicable at the time of booking. Prices may be adjusted if external costs change due to government regulations, park fee increases, currency fluctuations, or supplier adjustments.

3. What Is Included

Unless otherwise stated in the itinerary, tour prices generally include:

  • Safari or expedition vehicle and fuel
  • Professional driver-guides, mountain guides, and porters as per itinerary
  • Accommodation and meals as specified
  • National park and conservation fees
  • Permits and logistical support

Items not explicitly listed are not included.

4. Cancellations and Refunds

Client-Initiated Cancellations

Any cancellation must be made in writing. Refunds are subject to administrative and supplier cancellation fees.

The following cancellation charges apply:

  • More than 40 days before departure: Full refund less 20% administrative fee
  • 14–40 days before departure: 40% of tour price forfeited
  • 6–14 days before departure: 50% of tour price forfeited
  • Less than 5 days or no-show: No refund

Refunds will be processed within 30 days of cancellation.

5. Changes and Alterations

ApexLine Expeditions Limited reserves the right to:

  • Modify itineraries, accommodations, or transport arrangements if circumstances require
  • Substitute accommodations or services with comparable alternatives
  • Cancel a tour due to weather conditions, safety concerns, force majeure, or operational necessity

If a tour is cancelled by the Company before departure, clients will receive an equitable refund of payments made, excluding unrecoverable costs.

6. Client Conduct and Fitness

Clients are expected to:

  • Follow guide instructions at all times
  • Respect local cultures, wildlife, and environments
  • Declare any medical conditions that may affect participation

We reserve the right to refuse participation or remove a client from a tour if their conduct, health, or behavior jeopardizes safety or the experience of others. In such cases, no refund will be provided.

7. Risk and Assumption of Responsibility

Adventure travel, including mountain climbing and safaris, involves inherent risks, including injury, illness, altitude-related conditions, wildlife encounters, and unpredictable weather.

By participating, clients acknowledge these risks and accept full responsibility for their participation.

8. Insurance

Clients are strongly advised to obtain comprehensive travel insurance covering:

  • Medical emergencies and evacuation
  • Trip cancellation or interruption
  • Personal liability
  • Loss or damage of baggage and equipment

Insurance coverage is the responsibility of the client and is not included in tour costs.

9. Liability

ApexLine Expeditions Limited and its agents act solely as intermediaries for transport providers, accommodation facilities, and other service suppliers.

We shall not be liable for:

  • Injury, illness, death, or accidents
  • Delays, cancellations, or changes caused by third parties
  • Loss or damage to personal property

Our liability is governed exclusively by the laws of the country in which the tour takes place.

10. Force Majeure

The Company shall not be held responsible for failure to perform obligations due to events beyond its control, including but not limited to natural disasters, government actions, pandemics, civil unrest, or extreme weather.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.

12. Acceptance of Terms

By confirming a booking or participating in any tour or expedition, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
